By accessing or using this Site or by registering as a member of this Site, you consent to the use of your Personal Data (defined below) as described in this Privacy Policy (“Policy”). If you are unwilling to consent to our collection and use of your Personal Data as described in this Policy and to accept the terms in the Terms of Use you should not use the Site.

Collection and Use of Personal Data

Your privacy is important to WegoWise. We at times collect, retain and utilize Personal Data about you to operate our business and to make services and other opportunities available. The term “Personal Data” means personally identifiable information that WegoWise obtains about you, including your name, utility account access user name, utility account access password, credit card number, telephone number, physical address and email address. We recognize and respect your privacy concerns about this information. We obtain Personal Data in a variety of ways (for example, directly from your Site registration, from your other transactions or experiences with WegoWise or its affiliates, including comments and information that you submit when utilizing the “social networking” aspects of the Site, or from other third parties). Also, when you visit the Site, we collect information that does not identify you to measure the use of the Site and to improve the content of the Site, as described below.

We may ask you also to provide us with demographic information, such as information about your premises and utilities usage that does not identify you personally. If we combine demographic information with the Personal Data we collect, we will treat it as Personal Data under this Privacy Policy.

WegoWise uses your Personal Data (including your address) along with demographic data such as utilities usage information both internally and externally for ongoing analytics purposes, both in aggregated and user-specific form.

Activity Tracking

WegoWise may gather information automatically about your use of the Site through a variety of mechanisms, including server activity logging, browser cookies, web beacons and embedded scripts. More information about these technologies is provided below. This information is used to help us understand how users interact with the Site, provide information to help us improve the site, and provide mechanism for useful product features. We may utilize third-party services for data collection and analytics.

WegoWise does not collect Personal Data automatically, but may tie information that does not identify you (that is collected automatically) to previously submitted Personal Data. Whenever we associate automatically collected data with your Personal Data, we will treat it as personal data.

Log Files

As is true of most websites, WegoWise may gather certain information automatically and store it in log files. This information, which does not identify you, includes Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. We may use this information to track user habits and improve the functionality of the Site as a result of our observations.

Cookies

We use cookies to passively store information about your use of the Site, including your preferences and other session information. A cookie is a small text file stored on your computer. You may be able to configure your browser to accept or reject all or some cookies, or notify you when a cookie is set. However, you must enable cookies in order to use certain features of the Site.

We use cookies to confirm that users are logged in. By default, these cookies will persist until you choose to explicitly log out. Web Beacons

Small graphic images or other web programming code called web beacons (also known as “1x1 GIFs” or “clear GIFs”) may be included in our Site pages and messages. Web beacons may be invisible to you, but any electronic image or other web programming code inserted into a page or e-mail can act as a web beacon. Web beacons or similar technologies may be used for a number of purposes, including, without limitation, to count visitors to the Site, to monitor how users navigate the Site, to count how many e-mails that were sent were actually opened or to count how many particular articles or links were actually viewed.

Embedded Scripts

An embedded script is programming code that is designed to collect information about your interactions with the Site, such as the links you click on. The code is temporarily downloaded onto your Device from our web server or a third party service provider, is active only while you are connected to the Site, and is deactivated or deleted thereafter.

ETags

ETags, or entity tags, A feature of the cache in browsers. It is an opaque identifier assigned by a web server to a specific version of a resource found at a URL. If the resource content at that URL ever changes, a new and different ETag is assigned. Used in this manner ETags are a form of Device Identifier. ETag tracking may generate unique tracking values even where the consumer blocks HTTP, Flash, and HTML5 cookies.

Disclosure of Information

Except as indicated within this Policy, we will not sell, rent, transfer, or otherwise share information we have collected about you, including Personal Data, with third parties.

We may share or transfer your Personal Data as directed to do so by you (for example, where you direct us to use your account information to obtain, compile and analyze energy usage data relating to your property or properties), or where you consent to such disclosure.

If you do agree to have your Personal Data shared, your Personal Data will be disclosed to such third parties and all information you disclose will be subject to the privacy policy and practices of such third parties. We are not responsible for the privacy policies and practices of such third parties and, therefore, you should review the privacy policies and practices of such third parties prior to agreeing to receive such information from them. If you later decide that you no longer want to receive communication from a third party, you will need to contact that third party directly.

For example, we may submit your data to the EPA Energy Star Portfolio Manager service, from which we may retrieve an Energy Star rating (if available) for your building.

We may access, use, preserve, transfer and disclose your information (including Personal Data), including disclosure to third parties, to the fullest extent permitted by applicable law: (i) to satisfy any applicable law, regulation, subpoenas, governmental requests or legal process if in our good faith opinion such is required or permitted by law; (ii) to protect and/or defend the Site’s Terms of Use or other policies applicable to the Site, including investigation of potential violations thereof; (iii) to protect the safety, rights, property or security of the Site or any third party; and/or (iv) to detect, prevent or otherwise address fraud, security or technical issues. WegoWise may include a Site feature through which you can refer a friend.
