By accessing or using the Site or by registering individually or on behalf of your organization as a member of the Site (you and, as appropriate, your organization are collectively referred to hereafter as “User,” “you” or “your”) you signify that you have read, understand and agree to be bound by our Terms of Use and you consent to the collection and use of your information as described in this Privacy Policy (this “Policy”), which is incorporated into our Terms of Use by reference, whether or not you register on the Site. If you are unwilling to consent to our collection and use of your Personal Data as described in this Policy and to accept the terms in our Terms of Use you should not use the Site.

Collection and Use of Personal and Demographic Data

Your privacy is important to WegoWise. We at times collect, retain and utilize Personal Data about you to operate our business and to make services and other opportunities available. The term “Personal Data” means personally identifiable information, such as your name, utility account access user names, utility account access passwords, telephone number, physical address and email address. We recognize and respect your privacy concerns relating to this information.

We obtain Personal Data in a variety of ways; for example, we collect Personal Data directly from you if you subscribe to services on the Site, if you sign up for one of our e-mail newsletters, from other transactions or agreements directly with us, and through any comments or other information that you share directly with us through the Site.

We may also collect Personal Data or demographic data, such as information about your premises and utilities usage, directly from you or from third parties. For example, when you register for an account or subscribe on the Site, we may ask some questions about the size of your buildings, utility companies, etc. In addition, if you choose to give us or a permitted third party access to your utility accounts, we may collect information about your utility usage and costs from your utility service provider(s). Demographic data does not identify you personally and as such is not considered Personal Data. However, if we combine demographic data with the Personal Data we collect, we will treat it as Personal Data under this Policy.

If you are submitting data, especially Personal Data, on behalf of a third party, you are responsible for ensuring that you have the necessary permission to share that information.

Payment Information

We may ask you to provide us with your billing information (such as your credit card number, bank account number, and billing address) if you choose to subscribe to our services, but the portion of the Site platform where such payment information is entered is currently operated and controlled by Stripe (a PCI-compliant servicer that handles all of our payment processing). We do not review your billing information when you engage in a payment transaction through the Site, although we do know the amount that is charged to your credit card or debited from your bank account in any such transaction. Payment processing is governed by the Stripe Privacy Policy which we do not control, and as such we encourage you to review Stripe’s Privacy Policy before submitting any payments through the Site. Please note that we may change our payment processor at any time, and we will notify you of any such change.

Customer Service Information

We may collect data from you during customer service interactions through e-mail or through our live chat platform. Our customer service software is currently provided by Desk.com. Information you share while using these support functions may be collected by Desk.com as well. Activity Tracking

WegoWise may gather information automatically about your use of the Site through a variety of mechanisms, including server activity logging, browser cookies, web beacons and embedded scripts. More information about these technologies is provided below. This information is used to help us understand how users interact with the Site, provide information to help us improve the Site, and it allows us to personalize your experience on the Site. We may utilize third-party services for data collection and analytics.

WegoWise does not collect Personal Data automatically, but may tie information that does not identify you (that is collected automatically) to Personal Data you have (or someone authorized by you has) provided to us directly. Whenever we associate automatically collected data with your Personal Data, we will treat it as Personal Data.

Log Files

As is true of most websites, WegoWise may gather certain information automatically and store it in log files. This information, which does not identify you, includes Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. We may use this information to track user habits and improve the functionality of the Site as a result of our observations.

Cookies

We use cookies to passively store information about your use of the Site, including your preferences and other session information. A cookie is a small text file stored on your computer. You may be able to configure your browser to accept or reject all or some cookies, or notify you when a cookie is set. However, you may be required enable cookies in order to use certain features of the Site.

We use cookies to confirm that users are logged in. By default, these cookies will persist until you choose to explicitly log out. When you log in, you may choose not to stay logged in after you close the browser, in which case the cookies used to identify your logged-in status will terminate once you close your browser. Web Beacons

Small graphic images or other web programming code called web beacons (also known as “1x1 GIFs” or “clear GIFs”) may be included in the Site pages and messages. Web beacons may be invisible to you, but any electronic image or other web programming code inserted into a page or e-mail can act as a web beacon. Web beacons or similar technologies may be used for a number of purposes, including, without limitation, to count visitors to the Site, to monitor how users navigate the Site, to count how many e-mails that were sent were actually opened or to count how many particular articles or links were actually viewed.

Embedded Scripts

An embedded script is programming code that is designed to collect information about your interactions with the Site, such as the links you click on. The code is temporarily downloaded onto your Device from our web server or a third-party service provider, is active only while you are connected to the Site, and is deactivated or deleted thereafter.

ETags

ETags, or entity tags, are a feature of the cache in browsers. It is an opaque identifier assigned by a web server to a specific version of a resource found at a URL. If the resource content at that URL ever changes, a new and different ETag is assigned. Used in this manner ETags are a form of Device Identifier. ETag tracking may generate unique tracking values even where the consumer blocks HTTP, Flash, and HTML5 cookies.

Third-Party Tracking and Do Not Track

Third parties may use tracking technologies in connection with the Site, which may include the collection of information about your online activities over time and across third-party websites or online services. We do not control those tracking technologies and we are not responsible for them. However, you consent to potentially encountering third-party tracking technologies in connection with use of the Site and accept that our statements under this Policy do not apply to the tracking technologies or practices of such third parties.

We may aggregate your demographic data with that of other users in order to analyze and compare energy usage and cost trends and to create graphs, charts, and other infographics to share on the Site and elsewhere, and you consent to such use.

We may share or transfer your Personal Data as directed to do so by you (for example, where you direct us to use your account information to obtain, compile and analyze energy usage data relating to your property or properties), or where you consent to such disclosure.

We may share or transfer your Personal Data to our third-party consultants for use in connection with our services. Any such third parties shall be required to maintain the confidentiality of your Personal Data in line with this Policy and not use your Personal Data except in connection with our services to you.

The Site may allow you to create an account as part of a partnership with other organizations. Creating an account through one of these partner portals may result in your data being automatically shared with one or more of our partners, through their WegoWise accounts or through other means. In this situation, we will indicate on the relevant portals if your data will be automatically shared with a third party.

You may be presented with opportunities to receive information and/ or marketing offers directly from third parties. If you do agree to have your Personal Data shared, your Personal Data will be disclosed to such third parties and all information you disclose will be subject to the privacy policy and practices of such third parties. We are not responsible for the privacy policies and practices of such third parties and, therefore, you should review the privacy policies and practices of such third parties prior to agreeing to receive such information from them. If you later decide that you no longer want to receive communication from a third party, you will need to contact that third party directly.

In addition to those explicitly named herein, such as Stripe and Desk.com, we may use third-party vendors to perform certain services on behalf of the Site, such as hosting the Site, hosting and managing the data, designing and/or operating the Site’s features, tracking the Site analytics, enabling us to send you information, or performing other administrative services. We may provide these vendors with access to user information, including Personal Data, to carry out the services they are performing for you or for us. To the extent that we use third-party analytics service providers to evaluate and provide us with information about the use of the Site and viewing of our content, we may share Personal Data with these analytics service providers, and they may set and access their own cookies, web beacons and embedded scripts and other tracking devices on your computer or mobile device. WegoWise expects all of its vendors to operate under federal and state laws regarding consumer privacy.

For example, we may submit your data to the EPA Energy Star Portfolio Manager service, from which we may retrieve an Energy Star rating (if available) for your building.

We may access, use, preserve, transfer and disclose your information (including Personal Data), including disclosure to third parties, to the fullest extent permitted by applicable law: (i) to satisfy any applicable law, regulation, subpoenas, governmental requests or legal process if in our good faith opinion such is required or permitted by law; (ii) to protect and/or defend the Site’s Terms of Use or other policies applicable to the Site, including investigation of potential violations thereof; (iii) to protect the safety, rights, property or security of the Site or any third party; and/or (iv) to detect, prevent or otherwise address fraud, security or technical issues. WegoWise is a cloud-based web application that currently operates on top of various platforms including, at present, Amazon Web Services (AWS), SoftLayer, and Digital Ocean. This means that we do not operate our own servers, store your data locally, or interact with any credit card information directly. WegoWise uses Secure Sockets Layer (SSL) encryption to ensure that your interactions with the Site are secure and private. Any attempt to access the application, even public pages, through the standard unsecured HTTP protocol is rerouted to a secure connection.
